The following stipulations shall apply to the puppy as described in this contract:

A) The above puppy has been examined by the sellers veterinarian and is guaranteed to be as represented for a period of one year from the date of this contract.

B) Puppies will not be shipped by Air or Ground Services until the puppy has attained at least 10 weeks of age or longer in some cases.

NOTE: Puppies picked up at our home may leave at eight weeks, at the sellers discretion.

C) HEALTH NOTES: The following shall note any minor health conditions as determined by the seller’s veterinarian.

D) Please have your veterinarian check out this puppy as soon as possible (within one week of delivery). If a medical problem exists a replacement will be given upon returning the puppy within 72 hours to be examined by the Sellers veterinarian. Breeder has one year to provide replacement puppy. If the puppy was shipped, seven days will be allowed and the cost of shipping the puppy back will be refunded by the seller after the puppy is examined by the Sellers veterinarian and a medical problem is confirmed. If a problem does exist and the Buyer decides to not return the puppy the Buyer will be responsible for all vet bills incurred.

E) All Limited Registrations are considered to be Spay/Neuter contracts. Registration Papers may be held until proof of Spay/Neuter is provided.

F) All Unlimited Registrations are considered to be potential Breeders.

G) As a breeder of pure bred Shih Tzu dogs, you are expected to read, understand, and follow the guidelines of the American Kennel Club (AKC) and/or be licensed by the United States Department of Agriculture (USDA). To strive for responsible breeding, in the best interest of the Shih Tzu breed. And to screen and educate individuals and families where your puppies will reside.

H) This puppy will be guaranteed for 1 year for life-threatening, hereditary conditions. This does not include minor conditions such as umbilical hernias and tight nostrils which are prevalent in the Shih Tzu breed. If a condition does occur a replacement will be given upon return of the pup.  Breeder has one year to replace puppy. If the pup is kept, all vet bills will be the responsibility of the Buyer.

I) This Breeder has done everything possible to produce healthy sound puppies by raising the puppies in the best way possible in regards to diet, exercise, socialization and veterinary care. This puppy must be given follow-up shots for full immunity and also wormed regularly. A premium food such as Iams, Eukanuba, Science Diet, Bil-Jac, or other must be fed. Table scraps are discouraged.

J) If a sudden death occurs, an autopsy must be done by the Sellers veterinarian to confirm the cause of death. If the death is due to a health problem, a replacement pup of equal value will be given. Shipping expenses will be shared. If there is no apparent cause of death and I feel the owners are in no way to blame I will still send a replacement but they will be responsible for the shipping expenses. I will not be responsible for ailments resulting from second hand smoke, obesity, or lack of proper veterinarian care including regular vaccinations.

K) It is agreed that any puppies produced by the described puppy, not be sold to any owner of, employee of, or agent of, or wholesaler of purebred dogs. (Wholesaler meaning any Individual that buys puppy litter lots, or individually, for their own resale, sells puppies by the Litter, trades pups or puppies for articles, ET.)

L) Deposits are non-refundable, (A Deposit is half of the purchase price (or a lesser amount mutually agreed upon) and will hold your pup until 7 weeks of age. Full payment including all other expenses must be received by the time the pup is 7 weeks of age or the deposit will be forfeited unless arrangements have been mutually agreed upon, contract is void and the pup will be resold.  Buyer is responsible for all shipping expenses. When making payment through PayPal a 3% charge will be added.

M) Where a Pick puppy is part of any agreement, it is agreed that all puppies will be examined by The sellers veterinarian where possible, and their health is deemed to be without concern prior to any Selection being made.

N) IF THERE WERE TO BE A LEGAL BATTLE DUE TO BREEDER AND OWNER NOT AGREEING, ABSOLUTELY ALL LEGAL ISSUES WILL BE DEALT WITH IN THE STATE OF MICHIGAN PER THIS GUARANTEE, AND IS SUBJECT TO ALL MICHIGAN LAWS. OUT OF STATE LAWS ARE NOT VALID PER THIS GUARANTEE.  ALL ATTORNEYS OUT OF STATE WILL BE BILLED TO BUYER. UNDER NO CIRCUMSTANCES WILL A BUYER BE ALLOWED TO KEEP A PUPPY AND RECEIVE A REFUND.

GENERAL NOTICES:

1 - Please note that due to fraudulent Buyers, Refunds will not be made, Please make sure you are ready for this commitment.

2 - Mishu Shih Tzu Reserves the right to determine who may acquire one of our puppies.

3 - Due to fraudulent buyers, the buyer agrees that any disputes will be handled through negotiations, Chargeback's through Credit Cards or Paypal will not

    be attempted.

4 - The Buyer agrees that this contract is recognized to be the contract of record throughout all states within the continental United States of America.

5 - The Buyer agrees that puppies shall not be delivered until a signed contract is received at Mishu Shih Tzu.

I have read and understand the foregoing, and agree that all parts and portions thereof Constitute a legal and binding agreement.
